Comprehensive Liability Waiver & Release Agreement
Property Address: 4140 Felter Road, Milpitas, CA 95035-7302
1. Assumption of Risk
I/We, the undersigned, acknowledge that entering, residing, camping, attending events, working, or providing services on the farm property, around 33 acres, involves inherent risks, including but not limited to:
Uneven terrain, natural obstacles, pond(s), slope(s), wet/slippery ground(s), and wildlife encounters
Use of farm equipment, vehicles, and tools
Interaction/bites/chases with/by animals, pets, and pests/insects, either domestic or wild,
Weather-related hazards (heat, cold, storms, fire risk)
Risks associated with camping overnight, including campfires, cooking equipment, and exposure to natural elements
Risks associated with tenancy, property management, household work, contracting, and service provision (maintenance, cleaning, repairs, construction, deliveries)
Risks associated with events, parties, meetings, or conferences held on the property, including gathering(s) of any/all size(s), food(s) or food service(s), and recreational activities
I/We voluntarily assume all risks associated with entering, staying, working, attending, or participating in activities on the property.
2. Waiver and Release of Liability
In consideration of being permitted to enter, stay, camp, attend, reside, manage, work, or provide services on the property, I/We hereby release, waive, and discharge the property owner(s), its/their agent(s), employee(s), service provider(s), representative(s), and owner(s) of any/all residing animal(s) from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, injury, or death that may occur while on the property, whether caused by negligence or otherwise.
3. Indemnification
I/We agree to indemnify and hold harmless the property owner(s) from any claims, damages, or expenses (including attorney’s fees) arising out of my/our presence, tenancy, camping, event participation, management, work, or service provision on the property.
4. Children and Minors
I/We acknowledge that children and minors are especially vulnerable to risks on a farm property and during day &/ overnight stays or events. As parent(s) or legal guardian(s), I/We accept full responsibility for the supervision, safety, and conduct of any minor(s) accompanying me/us. I/We agree to the terms of this waiver on behalf of said minor(s).
5. Rules of Conduct
I/We agree to abide by all rules established by the property owner(s), including but not limited to:
No open flames except in designated areas
Proper disposal of trash and waste
Respect for animals, crops, and farm equipment
Quiet hours as designated by the property owner(s)
Immediate reporting of any hazards or injuries
Compliance with Airbnb/tenant agreements, property management policies, event guidelines, and contractor/service provider requirements
6. Workers, Contractors & Service Providers
I/We acknowledge that workers, housekeepers, contractors, and service providers may face risks associated with maintenance, cleaning, construction, and operational duties. I/We assume responsibility for my/our own safety and agree to release the property owner(s) from liability for any injury or accident occurring during such work or service provision.
7. Event & Gathering Participants
I/We acknowledge that parties, meetings, conferences, and other events may involve additional risks, including food service, alcohol consumption, recreational activities, and gatherings of any/all size(s). I/We assume responsibility for my/our own safety and agree to release the property owner(s),its/their agent(s), employee(s), service provider(s), representative(s), and owner(s) of any/all residing animal(s) from liability for any injury or accident occurring during such events.
8. Medical Treatment
I/We consent to receive medical treatment deemed advisable in the event of injury, accident, or illness during my/our visit, stay, tenancy, work, service provision, or event participation. I/We release and discharge the property owner(s), its/their agent(s), employee(s), service provider(s), representative(s), and owner(s) of any/all residing animal(s) from any responsibility for such treatment.
9. Governing Law
This agreement shall be governed by and construed under the laws of the State of California.

I consent to their participation in an activity on the farm property and agree(s) to all terms of this waiver on behalf of myself and the minor(s). I understand and accept the risks involved, including those arising from the negligence of the Releasees.
